Terms of Service

The ground rules for using our website, engaging our services, and buying our products.

These Terms of Service (“Terms”) govern your access to and use of spatialapex.co (the “Site”) and the services and products offered by Spatial Apex (“Spatial Apex,” “we,” “us,” or “our”). By using the Site or engaging us, you agree to these Terms. If you do not agree, please do not use the Site.

Who we are and what we offer

Spatial Apex is a spatial computing agency, education studio, and publisher based in Orlando, Florida. We provide strategy, creative, marketing intelligence, media, technology, and education & training services, and we publish and sell books and related materials. Specific engagements are governed by a separate written proposal or agreement (a “Service Agreement”); where a Service Agreement conflicts with these Terms, the Service Agreement controls for that engagement.

The free Spatial Snapshot

A “Spatial Snapshot” is a complimentary, tightly-scoped demonstration in which we turn one model, product, or space you provide into something you can experience. It is offered as a good-faith preview, is subject to availability and our discretion, and comes with no warranty or guarantee of any particular outcome, specification, or result. Providing a Snapshot does not create an ongoing obligation on either party.

Your materials and submissions

When you send us models, files, brand assets, or other materials (“Your Materials”), you represent that you own them or have the rights necessary to share them with us, and that our use of them for the requested work will not infringe anyone’s rights. You grant us a limited, non-exclusive license to use, reproduce, and modify Your Materials solely to deliver the services you request. You retain ownership of Your Materials.

Purchases, fulfillment, and refunds

Books and other products are sold through third-party commerce and fulfillment platforms (for example, Shopify for checkout, and Lulu or Amazon for print and retail). Your purchase is also subject to those providers’ terms. Prices, availability, and delivery timelines are as described at checkout and may change. Digital products are delivered electronically; physical products are produced and shipped by our print or retail partners. Because print-on-demand and digital goods are made or delivered on demand, refunds and returns are handled according to the applicable platform’s policy and any terms shown at the point of sale. If something is wrong with your order, contact us and we’ll help make it right.

Intellectual property

The Site and its contents — including text, graphics, layouts, the Spatial Apex name and marks, our books, curricula, figures, and other published materials — are owned by Spatial Apex or our licensors and are protected by intellectual-property laws. You may view and use the Site for its intended purpose, but you may not copy, reproduce, republish, resell, or create derivative works from our content without our prior written permission, except as expressly permitted (for example, personal use of a book you purchased). All rights not expressly granted are reserved.

Acceptable use

You agree not to misuse the Site or our services. In particular, you will not: use them for any unlawful purpose; attempt to gain unauthorized access to our systems; interfere with or disrupt the Site; scrape, harvest, or reproduce content at scale; misrepresent your identity or affiliation; or upload material that is infringing, harmful, or that you lack the right to share.

Third-party services and links

The Site relies on and links to third-party services (such as our host, store, payment processor, fulfillment partners, and fonts). We are not responsible for the content, policies, or practices of those third parties, and your use of them is governed by their own terms.

Disclaimers

The Site, the free Spatial Snapshot, and any content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Any strategic guidance, forecasts, or educational content we publish is provided for general informational purposes and is not professional, legal, financial, or investment advice.

Limitation of liability

To the fullest extent permitted by law, Spatial Apex and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site, services, or products. To the extent we are found liable, our total liability for any claim will not exceed the amount you paid us for the specific product or engagement giving rise to the claim (or, if none, one hundred U.S. dollars).

Indemnification

You agree to indemnify and hold harmless Spatial Apex from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site or services, or your violation of any law or third-party right — including any claim that Your Materials infringe someone’s rights.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, and you consent to their jurisdiction and venue.

Changes to these Terms

We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above, and the updated Terms take effect when posted. Your continued use of the Site after changes are posted means you accept them.
